CANADIAN CONSTITUTION, ENGLISH COLONIAL LAW AND ETHNOCENTRISM WHAT IS THE CANADIAN CONSTITUTION?
  • A venerable system of fundamental laws, policies and principles that describe how a government or state is organized and will function. Establishes the powers of the executive, legislative and judicial branches of government, Allocates powers to different levels of government, such as federal, provincial, and municipal. Indicates the rights of each citizen in relationship to each other and to the government, i.e., the Charter of Rights and Freedoms (1982). Outlines how the Constitution is to be amended. The Canadian Constitution is made up of a nucleus of written systematically arranged rules/laws. However, there are also unwritten rules called Conventions. Conventions could also be described as general agreements or longstanding customs on the usages and practices of social life. Both the Nucleus and the Conventions have been interpreted by the courts, and their decisions have lead to Constitutional case law. Needlesstosay, overtime a vast labyrinth of decisions have been made, making the Constitution a multi-facted document and rather outrageous document in terms of its compilation. (see below)
Canada's Constitution is extremely complicated because it was not created from a single draft, like the constitution of the United States. The Canadian Constitution is a quilt, that has been put together piece by piece, with some pieces more elaborate than others (somewhat like the federal tax laws!).

Redirected from Canadian Constitution The Canadian Constitution is the highest law of Canada. It outlines Canada's system of government, as well as the civil rights of all Canadian citizens. The constitution is made up of several parts:
  • The Constitution Act of 1867 . Formerly known as the British North America Act , this act was the act of the British Parliament that granted Canada self-government, and spelled out how Canada's government would operate. The Constitution Act of 1871 . Another former act of the British Parliament, this act outlines the procedures for allowing new provinces and territories to join the Dominion of Canada. The Constitution Act of 1982 . This was Canada's first "Canadian made" constitutional amendment, granting Canada full politicial independence from Britain, and incorporating a Canadian Charter of Rights and Freedoms outlining the individual rights of every citizen of Canada.
The Charter is by far the most of-cited portion of the constitution. The Constitution Acts of and , while certainly relevant, are generally not as well known. They have often been denounced as "messy," "almost incoherent" or worse for their somewhat convoluted and dated language.

    Was this done in a roundabout way to recognize and at the same time forestall, Quebec from seceding from the rest of Canada? I kind of read over the blurbs and noticed things about 'recognizing both languages' ie English and French and at the same time recognition of limitations of rights ie when it conflicts with whoever is in charge (ok, so that may not be quite right...)
    Interesting read. I note also the year ie. it's from 1982 so its 26 years old ie it has lots of years and precedent behind it, so it's entrenched now and would be difficult at best to get rid of (not that anyone has tried?) Precedent counts a LOT in lawyers and the laws eyes making law, from what I understand, hard to get rid of (which can be good or badlook at our Country ie Plessy vs. Ferguson from 1896 stood until 1954 in part b/c of the idea of precedent.)
