Preface
It is the balance between these various needs that drives the Jewish law discussion of all assisted reproductive technology and it is in that spirit that this is intended to be a preliminary analysis of the problem of cloning.
I. Introduction
An analysis of the implications of cloning found in Jewish law really contains within it three distinctly different problems in need of resolution. The first one discusses whether the cloning process is permissible ( mutar ), prohibited ( assur ), or a good deed ( mitzvah ). However, the determination of whether any particular conduct is good, bad or neutral is not dispositive in addressing the second issue: the familial status of an individual (re)produced through cloning in relationship to other humans generally, and other members of this person's "family" specifically. Finally, even when conduct is permissible or perhaps even a mitzvah, Jewish law recognizes that the (rabbinical) authorities of every generation have the authority to temporarily prohibit that which is permissible based on the perception that this intrinsically permissible activity could lead to other more serious violations.

HISTORICAL BACKGROUND
Advances in knowledge and related developments in the procedures of molecular biology, genetics and artificial fertilization have long made it possible to experiment with and successfully achieve the cloning of plants and animals. Since the '30s experiments have been made in producing identical individuals by artificial twin splitting, a procedure which can be improperly called cloning. The practice of twin splitting in the zootechnical field has been spreading in experimental barns as an incentive to the multiple production of select exemplars. In 1993 Jerry Hall and Robert Stilmann of George Washington University published data concerning the twin splitting they performed on human embryos of two, four and eight embryoblasts. These experiments were conducted without the prior consent of the appropriate Ethics Committee and were published, according to the authors, in order to stimulate the ethical debate. The sheep that shook the world. On Human Cloning: Three Views
The birth of Dolly, the first mammal cloned from the cell of an adult animal, sent intellectual and emotional shockwaves around the world when it was reported in early 1997. What's next? commentators asked. Could human beings now begin making carbon copies of themselves? If so, will those with the means use cloning to essentially cheat mortality? Could a form of the eugenics espoused by the Nazis now become reality if, say, a rogue government so chose? The cloning of human beings, many concluded, would be biologically wrong, socially misguided, and morally and ethically repugnant.
Yet some scientists began touting the enormous benefits that human cloning might bring. These include helping infertile couples who have had no luck with other infertility treatments to have children or allowing a parent bearing a gene for a debilitating disease such as Huntington's chorea to avoid passing the gene onto his or her child. In theory, specialists could also use cloning to grow embryonic stem cells into vital organs, blood, or tissue, which doctors could then use for transplants, transfusions, and other replacement interventions.
Here we present three points of view on this highly contentious issue. All three scientists are experts on the subject who all have the same facts at their disposal. Yet Dr. Lee Silver, a Princeton molecular biologist, remains bullish on the idea of cloning humans, while Dr. Rudolf Jaenisch, professor of biology at MIT, just as adamantly opposes the idea, under any circumstances. Dr. Don Wolf, a senior scientist at the Oregon Regional Primate Research Center, falls somewhere in between that is, he has serious reservations but is not opposed in principle.     JEFFERSON CITY, MO –  The Missouri Cures Without Cloning Initiative Campaign (CWC) won a partial legal victory today when the Missouri Court of Appeals ruled that  part of Secretary of State Robin Carnahan’s ballot summary was “insufficient and unfair.”  In the opinion, Judge Hardwick stated “Upon review of the Plaintiffs' initiative proposal, we find no language to suggest that it would repeal the ban on human cloning…. The Secretary's introductory language does not fairly summarize any goal or effect of the initiative proposal and is inadequate to give clear notice of its purpose.”  While this was a big victory for CWC’s efforts to present Missouri voters with a clean vote to ban human cloning in Missouri, we are disappointed the court upheld the unsubstantiated prediction that this amendment would limit patients’ access to stem cell cures and treatments.  There is no basis for this assertion.  We are evaluating our options regarding appeal to the Missouri Supreme Court and pursuing relief from the Secretary of State for violation of our constitutional rights.
