divorce law: an overview
There are two types of divorce absolute and limited. An absolute divorce, (also called a "divorce a vinculo matrimonii") is a judicial termination of a marriage based on marital misconduct or other statutory cause arising after the marriage ceremony. As a result of an absolute divorce both parties' status becomes single again. Several jurisdictions' statutes authorize limited divorces, or "divorce a mensa et thoro." The consequences of limited divorces vary from state to state. Typically, a limited divorce is commonly referred to as a separation decree; the right to cohabitation is terminated but the marriage is undissolved and the status of the parties is not altered. Many states have enacted what is called no-fault divorce statutes. This is a response to outdated common law divorce which required proof in a court of law by the divorcing party that the divorcee had done one of several enumerated things as sufficient grounds for the divorce. This entailed proving that the spouse had committed adultery, or some other unsavory act. No-fault divorce eliminates this potentially embarrassing and undesirable requirement by providing for the dissolution of a marriage on a finding that the relationship is no longer viable. It is hard to tell whether no-fault divorce statutes are the cause or an effect of the rising national divorce rate in America. Look to various

Jewish Attitude Toward Divorce
Judaism recognized the concept of "no-fault" divorce thousands of years ago. Judaism has always accepted divorce as a fact of life, albeit an unfortunate one. Judaism generally maintains that it is better for a couple to divorce than to remain together in a state of constant bitterness and strife. Under Jewish law , a man can divorce a woman for any reason or no reason. The Talmud specifically says that a man can divorce a woman because she spoiled his dinner or simply because he finds another woman more attractive, and the woman's consent to the divorce is not required. In fact, Jewish law requires divorce in some circumstances: when the wife commits a sexual transgression, a man must divorce her, even if he is inclined to forgive her. This does not mean that Judaism takes divorce lightly. Many aspects of Jewish law discourage divorce. The procedural details involved in arranging a divorce are complex and exacting. Except in certain cases of misconduct by the wife, a man who divorces his wife is required to pay her substantial sums of money, as specified in the ketubah (marriage contract). In addition, Jewish law prohibits a man from remarrying his ex-wife after she has married another man.

If in the future women achieve real economic equality with men, men will doing roughly half the unpaid work in the home that women now do. That is the main prerequisite of women's equality. If men are doing roughly half the unpaid work at home, that me ans that roughly half the primary parentsthe parents who stay home when Junior is sick, reduce their job-related travel, or stay at home for years while the children are smallwill be men. That is, the sexual division of labor in the home will have me lted away. Could that happen? I think so. One question we should look into carefully, though, is what effect such a big change would have on the rate of divorce. To help us evaluate how important a question that is, I would also like to explore what t he consequences of divorce are for children. First, what will happen to divorce rates? The honest answer is that no one knows. The research done by psychologists and physicians on two-parent families in which the father is the primary parent really doesn't yield good information about divorce rates in such families. We can speculate a little. Economists have found, for example, that as women's incomes rise in a country, the divorce rate rises, too. It seems that when most women have low incomes, few feel that they can afford to divorce. Wh en many women make enough to barely survive on independently, more bail out of marriages that make them miserable. The current trend, and the trend required if women are to achieve economic equality, is for women to greatly increase their incomes. That may increase the divorce rate. However, during the 1980's, when women's average earnings were rising considerably in the United States, divorce rates levelled off. Clearly, many other factors influence divorce rates.
