    The National Environmental Policy Act (NEPA) was passed in 1970 along with the Environmental Quality Improvement Act, the Environmental Education Act, and the Environmental Protection Agency (EPA). The main objective of these federal enactments was to assure that the environment be protected against both public and private actions that failed to take account of costs or harms inflicted on the eco-system. The EPA was supposed to monitor and analyze the environment, conduct research, and work closely with state and local governments to devise pollution control policies. NEPA (really enacted in 1969) has been described as one of Congress's most far reaching environmental legislation ever passed. The basic purpose of NEPA is to force governmental agencies to consider the effects on the environment of their decisions. State laws also reflect the same concerns and common law actions in nuisance allow adversely affected property owners to seek a judicial remedy for environtal harms harms.

Suing Big Energy for Global Warming?
posted by Frank Pasquale The Tom Ashbrook show features two innovative (and perhaps quixotic) attorneys who are suing "24 oil, coal and electric companies" for global warming on behalf of the "tiny fishing village of Kivalina," which is "falling into the sea." I predict the defense will be reading David Dana's paper "The Mismatch between Public Nuisance Law and Global Warming" very closely. Meanwhile, Dean Saul Levmore of Chicago predicts a " battle of the generations " on the issue, while Eric Posner and Cass Sunstein discuss what justice requires the US to do here . I was disappointed that these discussions did not adequately focus (or perhaps ignoredbut I can't claim to have listened to every minute) on the extraordinary waste of energy these stats on fleetwide standards for new vehicles: Japan: 46 MPG EU: 43 MPG China: 36 MPG US Cars: 27.5 MPG

Federal panel seeks more testimony on radiation barrier at Oyster Creek nuclear plant (Asbury Park Press)

Environmental Law Division
The Environmental Law Division represents the State of Iowa in issues affecting the environment. The majority of the division's work involves representing the Department of Natural Resources, the Department of Agriculture and Land Stewardship, and the Iowa Comprehensive Petroleum Underground Storage Tank Fund Board. The division prosecutes civil environmental enforcement actions involving water pollution, water supply, solid waste, air pollution, leaking underground storage tanks, hazardous conditions, and flood plains pursuant to Iowa Code chapter 455B, and animal feeding operations pursuant to Iowa Code chapter 459. The division is also responsible for implementing the One Call Education and Enforcement Initiative, including educating excavators and operators of underground facilities of the requirements of Iowa Code chapter 480 and, when appropriate, initiating civil enforcement actions. The division also defends its assigned agencies in citizen suits, civil rights actions, judicial proceedings, and other litigation. The division routinely advises the Department of Natural Resources concerning statutory and rule interpretations, administrative law questions, and enforcement strategies. The division reviews grants to cities for various environmental construction projects. The division also provides legal assistance to the DNR in matters relating to acquisition and management of state-owned lands and waters and development projects on state-owned lands including National Environmental Policy Act requirements, construction contract disputes, drainage disputes, permits and leases for special uses of public lands and waters, and regulations relating to fishing, hunting, trapping, boating and use of state parks. The division advises the DNR and other state agencies in matters relating to federal management of the Missouri and Mississippi Rivers.

    Environmental and Water Law
    Research in environmental law, and water law in particular, has led to multidisciplinary research projects, mostly with staff from the University's Urban Water Technology Centre and other academic partners and industrial collaborators. These have included EPSRC-funded projects, for example on decision-making in the water industry, as well as work for Scottish Water and the Scottish Environment Protection Agency, and involvement in the MANTRA-East project on environmental information in transboundary river basin management. Such collaboration is recognised to be of increasing importance for practitioners in the fields of the environment and water management. Recent publications include the results of these projects, as well as analysis of current reforms of Scottish water law, both in water services and water resource management, for national and international journals.

Welcome to the First Year Statutory Elective Environmental Law class.  The purpose of the elective program is to introduce you to fields of contemporary law that are dominated by complex regulatory statutes administered by executive branch agencies. We will study an array of topics, including the constitutional power of the United States to protect environmental quality, the separation of powers doctrine, federal-state relations, the lawmaking authority of executive branch agencies, standing and citizen enforcement of the environmental laws, and the generally deferential role played by the courts in the administration, interpretation, and enforcement of federal statutes.
This class will focus on several important federal environmental statutes, such as the National Environmental Policy Act, the Endangered Species Act, and the Clean Water Act.  During the course of the semester, we will study these statutes in detail and look at a variety of other topics in environmental law, including global warming and domestic regulation of greenhouse gas emissions, restoration of degraded ecosystems, regulation of nuclear power and disposal of nuclear waste, management of the national forests and public lands, and international efforts to save the whales.

Snakes'-Rights Activists Put Indian Snake Charmers Out of Work
Hunting or keeping snakes has been illegal in India since the passage of the Wildlife Protection Act of 1972. That law has been widely flouted (or maybe fluted) by snake charmers who pursued their art for centuries before the WPA was around, but "growing environmental awareness" has now caused the government to crack down on the turbanned reptile exploiters. "We now have accepted the fact that we cannot perform with snakes," said Hawa Singh Nath, a 68-year-old New Delhi resident who evidently speaks for all of India's snake charmers. (Maybe he's head of the union.) This may be sort of a mixed bag, however, since although a lot of snake charmers are now out of a job, the job they are out of seems to have sucked to begin with. "At the best of times," said the report, "snake charming is not a profitable profession," and the charmers tend to "live in squalid settlements on the outskirts of cities . . . ." Nath confirmed that under the new regime, "[w]e are hardly earning half of what we used to earn before," which has presumably doubled the squalidity quotent of charmer settlements. But there's no stopping the resourceful snake charmers of Rajasthan [or insert your favorite Indian state]. Having accepted the new snakes'-rights agenda, they are turning to other jobs to survive, primarily involving their skills with the flute. Many now do weddings or birthday parties, or just perform their ancient music

Belated March Madness-SEQRA and Zoning Cases from March, 2008
Due to a busy litigation schedule, we fell short in reporting a number of SEQRA and zoning cases that came down during March of 2008. So we thought we would provide a brief summary of some of the cases decided by New York appellate courts during March of 2008, in case you missed them also. Rossi v. Town Bd. of Ballston, 2008 NY Slip Op 02740 (3d Dep’t Mar. 27, 2008). SEQRA-the burden is on the party challenging a SEQRA determination to provide evidence to refute expert testimony. Muir v. Town of Newburgh Planning Board, 2008 NY Slip Op 02596 (2d Dep’t Mar. 18, 2008). SEQRA-a full review of environmental impacts of a prior proposal that did not proceed was sufficient for a SEQRA “hard look” at a new scaled down proposal for the same site.

Prohibits unauthorised discharges of contaminants to land and water. Put simply, this means that nothing but rainwater can be discharged onto the ground, into stormwater drains or into streams, lakes or the sea without authorisation from the Regional Council. It is illegal to cause pollution and substantial penalties can be imposed, including fines up to $200,000 and up to two years imprisonment.
