According to the Family Firm Institute of Brooklyn, Massachusetts, "nearly 70% of all family firms fail before reaching the 2nd generation, and 88% fail before the 3rd generation; only a little more than 3% of all family enterprises survive to the 4th generation and beyond." The third generation seems to be the brittle generation. Hence, the saying, "Shirt sleeves to shirt sleeves in three generations!" (Or in Asia, "Rice paddy to rice paddy in three generations!"). A common misconception is that the estate tax is the cause of this loss of wealth. Nothing could be further from the truth. The loss of wealth occurs at the same rate in countries with no death or estate tax, such as Australia! One of the greatest challenges facing affluent individuals, families and businesses is how to control, protect and empower their human, intellectual and financial capital. As Albert Szent-Gyorgyi once said, "Discovery consists of seeing what everybody has seen and thinking what nobody has thought." Rather than taking just a financial approach to estate planning, we should also focus on the perpetuation of a family's human and intellectual assets. In his book, Finding The Better Way, multi-billionaire James LeVoy Sorenson said, "My family and good health are what make me truly rich... True wealth only comes through health and family and friends."

    We spend most of our lives planning. Some of the things we plan, such as what to have for dinner or the route we'll take to work, are so trivial they require little thought. Other things, such as a family vacation, the correct bid for a big project, or purchasing a new home, require a great deal of thought and planning. All day, every day, we plan. Yet, many of us fail to plan for one of the most important tasks of all – what will happen to our possessions and electrical business once we're gone. There are many excuses for not facing this task. Some simply believe that once they reach those golden years there won't be enough left to plan for. Others believe their heirs can work out the details. Still others simply aren't willing to face their own mortality. But the biggest problem for the electrical worker who has been in the electrical contracting business for 35+ years is a lack of planning for retirement or the transfer of assets. Planning for the distribution of your estate isn't necessarily difficult, but it does require serious thought. Here are 10 steps to help you with this most important planning process.

Unfortunately, the vast majority of Canadians ignore issues relating to their own death, with tragic consequences. There are three reasons why estate planning is a major component of our business: - Without proper estate planning, a great deal of money and value is lost to the government in Ottawa and Victoria in taxes, and to probate, estate administration, legal and accounting fees. This is commonly called Estate Erosion or Estate Shrinkage Unnecessary. - Without proper estate planning, grieving survivors and heirs are left to deal with 'the mess', sometimes not knowing what the deceased owned, where it is, or what needs to be done. Easily avoidable - Without proper estate planning, and clear communication, grieving survivors and heirs do what 'they' think is right, and when the dust settles, family relationships are destroyed forever. Tragic. Estate planning is often uncomfortable. The discomfort is not an excuse to ignore estate issues. We all know people who have siblings who haven't spoken to each other for decades because of an estate dispute. DO NOT let this happen in your family! Quite frankly, nothing matters more. Do not procrastinate on this. Start getting your affairs in order. As a certified financial planner, I have dealt with hundreds of client families over the years, and I have gone through the process of helping surviving family members whose deceased relatives have planned well, and otherwise. Every family situation is unique. Every estate plan is different.

Estate planning applies the law of property, wills, trusts, insurance and taxation to the ordering of financial affairs.
Probate
Probate is the process of proving a will and the legal process of administering the estate of the deceased. If a person dies owning property that is administered by the probate court usually by having a will, there is a "probate estate." Assets in the probate estate are listed in an inventory filed with the probate court. The probate estate must pay estate taxes and all claims against the estate before it is distributed to the heirs. This process is usually carried out by the executor or administrator of the estate under the supervision of the court. There are ways to avoid probate such as setting up a living trust. Estate Tax Marital Deduction An estate in Massachusetts is generally allowed to pass tax free to the surviving spouse-this is known as the Marital deduction. The marital deduction also applies to the Federal Estate tax. This deduction can be used to avoid some estate taxes. Trust A trust is a legal entity created by a grantor in which "title" to the property is vested in a trustee, but the benefits of ownership are enjoyed by another person- the beneficiary. The trust imposes fiduciary obligations on the trustee to act to the benefit of the beneficiary. Generally the trustee must manage the trusts assets and income for the economic benefit of the beneficiaries.Trusts may be revocable (also known as living trusts) in which the creator retains the right to alter, amend or revoke trust. Irrevocable trusts cannot be altered and usually are created at death.

"PAY-ON-DEATH" BANK ACCOUNT A bank account can be designed to belong to one person during his or her life and, subsequently, to pay to another person, trust or institution ... at the death of the original owner. Such an account is often called a Pay-on-Death (POD) bank account. In many instances, this is an excellent estate planning device. Suppose that you have a substantial savings account and that you have one heir that you want to receive that account at your death. You merely go to the bank and tell the officer that you want to own the account during your life ... but, that you want a certain person, whom you then name, to be the owner when you die. The bank officer will give you the proper documentation, generally at no cost. Unfortunately, many planners are unaware of the POD account. Consequently, they often endanger their assets by using other means. Often, they place their children's names on bank accounts as joint owners. While joint ownership may be desirable in many instances, it has one major drawback. If your child, the other joint owner, were to be sued and if a judgment were granted against your child, your bank account could be at risk. So, it is often better to use the POD account than to use joint ownership. With the POD account, the second owner has no legal interest in the account as long as the first owner is alive. Having no legal interest in the account, the second owner cannot lose the account to a lawsuit during the first owner's life.

cc je lc When an individual writes a will, he or she must appoint an executor of the estate, who is responsible for carrying out the will and any other instructions. While the role of executor may not be difficult, it may require certain skills, such as an ability to be diplomatic and a strong sense of responsibility. The duties of the executor include: Determining what the individual owns; Paying any bills and claims against the estate, including funeral costs; Paying all estate and inheritance taxes; Collecting any money due on the estate; Handling other estate assets such as insurance or trusts; Overseeing the investment of assets in the estate; Distributing assets and property according to the will; and Settling the estate with the probate court. Ascertaining Estate Assets The executor will need to determine what assets comprise the estate, such as property, pensions, investments, insurance benefits from employers, and other insurance policies. In some cases, a letter of instructions and/or a list of assets may have been included with the will. Since estate assets may include various bank accounts or property in several locations, a list can be most helpful to the executor. Even without instructions, the executor must locate all assets to be distributed. Some assets may need to be valued. The executor may hire appraisers to assess the value of an art collection, real estate property, furniture, or household goods. Once valued, the executor may decide whether to distribute property directly or sell it and divide the proceeds among the heirs. The executor may want to first consult with the heirs regarding which type of distribution they would prefer.
