  • Our son has been working for a landscaping firm for two years. He is paid on an hourly basis, but he believes he is paid as a contractor. He supervises a junior and communicates with the boss by telephone. At the end of each job, our son sends in an invoice. He is not paid when between jobs, he cannot delegate jobs to someone else, nor does he supply his own tools. He has his own ABN and he pays his own tax, but he doesn't get superannuation, sick leave, etc., and he can't afford his own accident or public liability insurance. Is he a contractor or an employee?
