Impeachment
U.S. Constitution
Impeachment is the process that enables a legislative body to remove a public official from office; it is composed of two parts: (1) an accusation or indictment and (2) a trial. This practice has its roots in English constitutional history. Members of Parliament employed impeachment against royally appointed Stuart officials in the 1600s. The concept was brought to the American colonies, where legislative assemblies used it against royal officials. Few other countries have provisions for impeachment. The U.S. Constitution makes the following provisions for the impeachment of federal officials: Article I, Section 2 Clause 5: The House of Representatives shall choose their Speaker and other Officers; and shall have the sole Power of Impeachment. Article I, Section 3 Clause 6: The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present. Clause 7: Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party, (defendant), convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.

Historic Background on the Impeachment and Trial of President Andrew Johnson
The Significance of President Johnson's Impeachment and Trial Johnson's impeachment trial is considered to be important because it checked the attempt among certain Members of Congress to establish congressional control of federal policy and relegate the President's role in governance to that of a chief minister's. The acquittal of Johnson also prevented later Congresses from using the threat of impeachment as a means of settling policy differences with the executive. Finally, the acquittal meant that in future impeachment trials the defendant would have to have committed an actual crime in order to be convicted. The Impeachment The Senate Trial sine die without considering the remaining articles.

Nixon, President of the United States, is impeached for high crimes and misdemeanours, and that the following articles of impeachment to be exhibited to the Senate: ARTICLES OF IMPEACHMENT EXHIBITED BY THE HOUSE OF REPRESENTATIVES OF THE UNITED STATES OF AMERICA IN THE NAME OF ITSELF AND OF ALL OF THE PEOPLE OF THE UNITED STATES OF AMERICA, AGAINST RICHARD M. NIXON, PRESIDENT OF THE UNITED STATES OF AMERICA, IN MAINTENANCE AND SUPPORT OF ITS IMPEACHMENT AGAINST HIM FOR HIGH CRIMES AND MISDEMEANOURS. ARTICLE 1 In his conduct of the office of President of the United States, Richard M. Nixon, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his consitutional duty to take care that the laws be faithfully executed, has prevented, obstructed, and impeded the administration of justice, in that: On June 17, 1972, and prior thereto, agents of the Committee for the Re-election of the President committed unlawful entry of the headquarters of the Democratic National Committee in Washington, District of Columbia, for the purpose of securing political intelligence. The Impeachment of Andrew Johnson No U.S. president has ever been removed from office by the impeachment process. One president, however, came close. In 1868, the House of Representatives impeached Andrew Johnson. At his trial in the Senate, Johnson escaped conviction by a single vote. In the election of 1864, Abraham Lincoln, a Republican, chose Senator Andrew Johnson, a Tennessee Democrat, as his vice-presidential running mate. Lincoln believed that Johnson, the only senator from a rebel state to remain loyal to the Union, would help persuade Democrats to vote Republican. After Lincoln was assassinated, Andrew Johnson took the oath of office on April 15, 1865. Two profound questions faced the nation. First, under what conditions should the Southern rebel states be readmitted into the Union? Second, what rights should the freedmen, or ex-slaves, have? A little over a month after becoming president, Johnson began executing his plan for reconstructing the South. Johnson pardoned all rebels except Confederate leaders. He also restored all rebel property except for slaves. Finally, he authorized each rebel state to call a convention of white delegates to draw up a new constitution. Once completed, a new state government could then be formed, and the state could apply for readmission to the Union.

Herszenhorn It’s hard to know which effort has longer odds, the bid by Representative Dennis Kucinich, Democrat of Ohio, to become president of the United States, or his bid to unseat Vice President Dick Cheney by trying to get him impeached. Both efforts got a brief burst of publicity today when Mr. Kucinich brought his bill to impeach Mr. Cheney to the House floor and, with the surprise help of Republicans aiming to embarrass Democratic Congressional leaders, nearly succeeded in securing an hour of debate. After a motion to table Mr. Kucinich’s bill failed, the majority leader, Steny H. Hoyer, Democrat of Maryland, stepped in with a motion to refer the bill back to the House Judiciary Committee. That motion succeeded, by a near party-line vote of 218-194, and spared the Democrats a potentially embarrassing distraction.
    House Republicans initially opposed the effort to debate Mr. Kucinich’s impeachment measure and briefly there were 290 votes in favor of tabling it.
