Legal ethics refers to an ethical code governing those in the practice of law . In many places, lawyers are bound by an ethical code that is enforced by self-governing bar associations , which have the authority to disbar members who engage in unethical professional behavior. American law schools are required to offer a course in professional responsibility , which encompasses both legal ethics and matters of professionalism that do not present ethical concerns. While legal codes of ethics differ from place to place, they tend to have some common statutes governing things like conflicts of interest, incompetence, bribery, coercion, communications with jurors, coaching witnesses, and so on. edit

January 19, 2007 Representing Co-Accused - Is the Temptation Worth the Risk? In R. v. Kim the Court of Appeal found that defence counsel was in an impossible conflict in representing two co-accused. It thus struck out the Appellant's guilty plea and ordered a new trial. The case is an exemplar for defence lawyers of how not to represent co-accused. Conflicts are extremely common when co-accused are represented by a single lawyer (or by members of the same firm or lawyers sharing office space). Sometimes even a waiver of conflict after independent legal advice cannot remove the taint. In ... Comments (0)
January 15, 2007 Follow Up - Mistrial Follows Lawyer-Witness Clash Last week we described a near-fight that took place between a Crown witness, Todd Kealy, and the defence lawyer who was cross-examining him, Reid Rusonik. The upshot of the imbroglio was that the judge ordered Rusonik to have no contact with Kealy, and another lawyer was retained to finish the cross-examination. Rusonik apparently remained on the case as counsel. The trial resumed with Kealy's continued cross-examination, but after a break the court learned that Rusonik had defied its order and made contact with Kealy, it appears because he was concerned that Kealy was out for revenge and might hurt Rusonik's family. Rusonik ended up taking the stand in order to provide this explanation to the court. As matter then stood at that point, the judge was considering whether to order a mistrial.

I've talked previously about the FlashPoints e-mail newsletters offered free of charge by the Illinois Institute for Continuing Legal Education (IICLE). You can sign up here for the newsletters. A settlement was reached, but it was unclear whether the settlement extended to certain accounts owned jointly by Evon and her mother (Evon's mother had added Evon to these accounts). Here's problem #1, and it relates to settlement negotiations generally: it's imperative that EVERYONE know and agree about the nature and extent of the settlement. That wasn't the case here from FlashPoints:
Following the mediation, one of the opposing attorneys contacted Mr. Potts to seek clarification on whether the agreed to settlement included the joint accounts. In a letter, counsel asked Mr. Potts to let the attorney know whether there was a dispute on this issue. Tyson told Mr. Potts not to answer and so Mr. Potts did not do so. Later, Mr. Potts circulated a stipulation that was filed with the court stating that the settlement was to resolve "all disputes" regarding "the estate" and dismissed both the will contest and the conservatorship proceeding

    As provided for by Canon 1, Rule 1.02 and Canon 3, Rule 3.05 of the Code of Judicial Conduct, a judge shall administer justice without delay and dispose of the courts business promptly and decide cases within the required periods. Justice delayed is often justice denied. Any delay in the administration of justice not only results in depriving the litigant of his right to a speedy disposition of his case but it also negatively affects the image of the judiciary. In the case of Judge Apostol, he had failed to live up to his bounden duty as a judge and should be administratively dealt with accordingly. He should opted for early retirement when it became apparent that he could no longer perform his duties as a judge because of his failing health. However, Judge Apostol was ordered to pay only P10,000 for gross neglect of duty rather than P20,000 as recommended by the Office of the Court Administrator to lessen the burden of the judge caused by his illness.     Course Description:
    American justice is discovered or determined in an adversary system by an impartial tribunal with reliance upon parties/lawyers to present the cases of the client and challenge those raised against them. The lawyers' job is to present the case most favorable to the client; they are not permitted to step outside this role. Legal ethics are therefore based upon the assumption that lawyers must pursue their client's interest without regard for the rightness or justice of the cause. One of the objectives of this course is to examine whether such a system can discover the truth and the role that morality takes on in our society as a consequence of such a system. We begin the course by examining philosophers' interpretations of justice and morality particularly with a focus on the establishment of a free nation. We will conduct an in depth study of how the existing American adversarial system defines justice and the assumptions that are thereby created. We will study the human genome sequencing project to broaden our ethical and legal perspectives; a study of the Truth and Reconciliation Commission in South Africa will highlight the effectiveness of a system seeking truth versus justice. We will look at foreign legal systems as alternative solutions.
