sports law: an overview
Sports Law encompasses a multitude areas of law brought together in unique ways. Issues such as antitrust, contracts, and torts are quite common. For further information in these areas see: Sports Law can be roughly divided into the areas of amateur, professional, and international sports. The distinction between a professional and amateur athlete is somewhat tenuous. So-called "amateur" student/athletes at universities often receive scholarships and other forms of compensation. Also, keep in mind that even though an athlete may be defined as an amateur by one organization, he or she may not be an amateur according to another. Of course, this leads to even more confusion. A simplistic, yet useful definition is that amateur athletes participate in sports as an avocation while professional athletes are involved in sports as a vocation.

  • Boucher v. Syracuse University (2nd Cir., 1999) Partial reversal of summary judgement for Syracuse and remand for consideration of allegations that Syracuse's athletic program violated Title IX sex discrimination regulations.
  • Cohen v. Brown University (1996) Found that Brown University was in violation of Title IX provisions when it demoted certain womens teams from university-funded to donor-funded. Case was appealed to the Supreme Court in 1997.
  • Franklin v. Gwinnett County Public Schools 503 U.S. 60 (1992). Title IX action by a high school student for sexual harrasement by her physical education teacher. Court found that Title IX does permit awards of damages.
  • Mercer v. Duke University (4th Cir., 1999). Suit by female placed kicker alleging discrimination in her removal from the Duke University football team. Court finds that where the school has permitted a student of the opposite sex to try out for a single-sex team in a contact sport, they are subject to Title IX.

Most participants in sport accept this risk as part and parcel of the activity. Frequently sports injuries are of a relatively minor nature. When a full recovery is made promptly, no-one is normally troubled as to who might be to blame. However, when a sports person suffers a significant injury, particularly one which has an adverse effect on a career or hobby, then attention often turns to who might be held responsible. It could be another participant, referee, spectator, governing body, local authority, school, the organiser of a sporting holiday or a manufacturer or supplier of sporting goods. With the increasing number of claims for sporting injuries being made, plus the likelihood of an increase in claims in the future due to greater awareness of legal rights (and the introduction of Conditional Fee Agreements), Sports law is now becoming a subject in its own right; much the same way as has happened in medical law.

    Sports Law Conference
    "The Advanced Seminar in Sports Law" will be held Sunday through Monday, April 28-29 at the Sheraton Hotel in South Portland. It is designed for coaches, athletic administrators, superintendents, principals, youth sports organizers, EEO officers and others. The conference opens with a workshop on the potential legal liabilities for coaches and administrators when dealing with evaluation of medical exams, conditioning and related issues. A second workshop will identify the risks inherent in the operation of sports facilities and procedures that can limit legal liabilities. Other topics to be examined include nutrition, eating disorders, sexual harassment, employment issues, hate crimes, and development of a gender equity plan. Other presenters include Stephen Wessler, former civil rights attorney with the Maine Attorney General and currently director of USM's Center for the Prevention of Hate Violence; Dave O'Brien, an attorney, consultant and former Division I athletic director; and Dr. William Dexter, a Portland-based physician who is board certified in family practice and sports medicine. Continuing education units are offered. Special rates are available for multiple registrations from the same organization and registrations received prior to April 19.        Every athlete is different in his approach to training and what he responds to best.  Terry will work with you to find the optimal draft preparation program that will maximize your performance at the combine.    Terry’s experience advising candidates for the United States Senate and the U.S. House of Representatives makes him uniquely qualified to craft the message and image that you desire to the public and the media.  Career Management:    In a perfect world, the professional athlete would just play the game and collect his salary.  Unfortunately, sometimes things don't go as planned.  When that happens, Terry is prepared to represent you in grievance proceedings, hearings and appeals with the league.  Terry will also act as your liaison with your team when necessary.  In addition, Terry is knowledgeable of the NFL’s procedures for collecting benefits when injuries occur as well as the retirement programs.
