by Ward Lowe The complexities of the federal tax code breed plenty of myths about the operations of the IRS. You may have heard tales about how to file an "audit-proof" return or how to challenge the legality of the government’s tax system. Most of these stories are myths, and some common ones are presented below: "I’m more likely to get audited if …" Many myths exist about what causes you to get audited. Some claim that using the preprinted tax label increases your audit chances, when it actually just speeds the processing of your return. Others have long held the belief that your odds of an audit increase as your salary climbs. But in recent years, more audit resources have been dedicated to non-filers, and the audit rate has increased for lower-income groups. Taxes are unconstitutional. Tax Planning Tips for 2000 and Beyond
It's important to keep in mind simple tax strategies when preparing for tax season. Many of these strategies, however, can be implemented at any time during the year. Contribute to an IRA - and do it early in the year.
If a taxpayer contributes $2,000 annually to an IRA at the beginning of the year, the account will be worth $540,585 (assuming a 12% return) at the end of 30 years. However, if the taxpayer makes the same contribution at the end of the year, the IRA would be worth only $482,665 in 30 years. Pay IRA fees from separate funds.
Having custodial fees deducted from an IRA each year significantly reduces the account's long-term value. A $50 fee deducted from a taxpayer's IRA at the beginning of each year for 30 years will reduce the account's value by 13,515 (assuming a 12% return). Most banks and brokerage firms permit customers to pay the custodial fee separately rather than have it deducted from the account. Fees paid from separate funds are also deductive as a miscellaneous itemized deduction. Establish a Roth IRA.

Tax evasion usually entails taxpayers deliberately misrepresenting or concealing the true state of their affairs to the tax authorities to reduce their tax liability, and includes, in particular, dishonest tax reporting (such as underdeclaring income, profits or gains; or overstating deductions). Part 5 on habeas corpus has been added to the article and has been mailed to all known prisoners, including a couple of lawyers, convicted of income tax charges. There are three known applications that have been made in district court and two are now on the way to circuit court. Third hand reports indicate the legal analysis is also being used in the Dick Simkanin case in Ft. Worth as a challenge to the indictment.

The government at some time passed many of its responsibilities to administrative agencies, which is the fourth branch of the government.
Hence, the IRS has the responsibility of collecting taxes. Employers are required by law to withhold Federal income, Social Security and Medicare taxes from employees paychecks. (see IRS Pub 15 and Employment Tax Enforcement However, there is a minimum amount which an employee must earn before the employer must withhold taxes. Also, if an employee is a 'statutory employee', the employer does not withhold federal income taxes. Self-employed persons must handle the responsibility of paying their taxes. There are some exempt persons and organizations. For instance churches and non-profit organizations are ususually tax exempt.
