Sioux County Cattle Operation Pays $40,000 Penalty
for Water Pollution Violations
Judge orders penalty for pollution and manure-handling violations at 12,000-head operation near Sioux Center. A.G. also announces lawsuits alleging violations at feeding operations in Howard and Pocahontas counties.
Des Moines. Consent Order, Judgment and Decree lawsuit alleged that Farmers Cooperative Society illegally released manure which discharged into an unnamed tributary of Six Mile Creek on September 22, 2005, and March 31, 2006, causing water quality standards violations. Farmers Cooperative also failed to provide notice to the Dept. of Natural Resources of the September 22 manure release. Another manure release occurred on January 26, 2006, but the manure did not reach a stream. On February 3, 2006, Farmers Cooperative also applied manure within 200 feet of Mile Creek without injecting or incorporating the manure, the suit said. The Farmers Cooperative Society cattle-feeding facility has about 10,000 head housed in four confinement buildings, and about 2,000 head in open lots between the buildings. In 1998, Farmers Cooperative Society paid an administrative penalty of $2,000 and $1,398.32 in restitution for a fish kill that resulted from a release of manure from the facility and pollution of over 16 miles of Six Mile Creek.

Under the Clean Water Act (CWA), Section 106, the WPC Program is tasked with monitoring the marine waters of the USVI, and controlling discharges into those waters. Major objectives of the WPC Program are to:
  • Ensure compliance with Territorial water quality standards; Build and maintain information management systems for ongoing data analysis and the development of critical environmental parameters; Monitor the health of potentially threatened biological communities; Prevent degradation of marine waters by carefully reviewing development proposals; Ensure that discharges to the waters of the USVI meet the requirements established by the CWA and the Territorial Pollutant Discharge Elimination System (TPDES) Permitting Program.

      Due to a growth in population and consumerism, water regulators and policy makers are being challenged to find ways to stretch available supplies further to sustain demand.
    What is water pollution?
    • Pollution in water can be in one of two forms. It is possible that nature itself can produce these imbalances as the natural composition of some water makes it unfit for certain uses: e.g., water flowing in the highly saline terrain of the prairies or gushing from highly mineralized springs in some parts of the country cannot sustain fish populations. More likely, however, waterways are being polluted by municipal, agricultural and industrial wastes, including many toxic synthetic chemicals which cannot be broken down at all by natural processes. Industries discharge a variety of pollutants in their wastewater including heavy metals, organic toxins, oils, nutrients, and solids. Discharges can also have thermal effects, especially those from power stations, and these too reduce the available oxygen. Silt-bearing runoff from many activities including construction sites, forestry and farms can inhibit the penetration of sunlight through the water column restricting photosynthesis and causing blanketing of the lake or river bed which in turns damages the ecology..     Surface Water Pollution Surface water pollution is still a problem in Northeast Wisconsin despite decades of effort, partly due to industrial and sewage pipe discharges into lakes, rivers and streams. Though wastewater treatment plants have been built and some regulations have been passed, our region's population continues to grow rapidly and industrial production is increasing. Incremental improvements in wastewater treatment are sometimes negated by sheer volume. Couple this with loopholes in the laws and compromised water quality standards, and we still have a lot of work to do to protect public health and wildlife from water pollution.     Political Pressure and Corruption
    - The Wisconsin Dept. of Natural Resources (DNR) has prime responsiblity for enforcing the federal Clean Water Act and additional state rules, but is under constant pressure from lawmakers and lobbyists to weaken the rules, or grant variances and exemptions to specific projects or industries. In recent years, the DNR has suffered severe budget and staff cuts, and two dysfunctional reorganizations. While we tend to blame the DNR for environmental problems, the real culprits are the Governor and State Legislators who control the agency. Lack of leadership and campaign corruption are the real problems. (See Campaign Finance Reform Compromised Health Standards - Water quality standards, which are used to regulate the discharge of wastewater, are the product of intense negotiations during the state rule-making process. The DNR generally creates Advisory Committees which include lobbyists for many of the sources of the pollution, and these committees are charged with trying to find "consensus" on what the standards should be. This often results in compromises which don't fully protect public health or wildlife. Some regulations never pass because of this political process. Two recent examples are the DNR's proposed Mercury Control Rule, which Republican legislators have blocked from passing, and the
