These Regulations implement, in relation to town and country planning, roads and drainage works in Scotland, Council Directive 85/337/EEC on the assessment of the effects of certain public and private projects on the environment.
The Regulations impose procedural requirements in relation to the consideration of applications for planning permission under the Town and Country Planning (Scotland) Act 1997 . Environmental Impact Assessments are required for certain developments, which are either to be carried out in a sensitive area, or that satisfy a threshold or criterion.
Planning permission for EIA development will not be granted unless the planning authority or the Scottish Ministers have first taken account of the environmental information that is before them. The procedures include seeking a 'screening opinion' of the planning authority to determine whether the development is an EIA development, followed by 'a scoping opinion' on the information to be included in an environmental statement from the planning authority. The planning authority must consult bodies with environmental responsibilities such as SEPA before adopting a scoping opinion or scoping direction.

In the majority of cases, the environmental effects of small scale renewables development should not be a factor in relation to the application of permitted development rights or the processing of a planning application for such development. However, you should note that where a development involves the installation of more than two wind turbines, or the hub height of any turbine or height of any other structure for harnessing wind power for energy production exceeds 15 metres, the Planning Service is likely to require an environmental statement under the Planning (Environmental Impact Assessment) Regulations (Northern Ireland) 1999. You are advised to confirm this with your Divisional Planning Office.

Environmental Impact Assessment
Environmental Impact Assessment (EIA) is a system for ensuring that the environmental effect of new developments are fully understood and taken into account before it is allowed to go ahead. The Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1999 set out the requirements for developers to provide environmental statements. All development projects listed in Schedule 1 of the regulations require EIA. For projects listed in Schedule 2 of the regulations, local planning authorities must decide whether EIA is necessary (a screening opinion). If a developer disagrees with the local planning authority's decision that EIA is required or if the authority fails to issue any opinion within three weeks, the developer may ask the Secretary of State to make a screening direction indicating whether EIA is required. We will normally do this within three weeks of the request. The aim of the screening process is to identify those projects that are likely to have significant effects on the environment. Schedule 2 to the regulations specify thresholds for types of development and Schedule 3 sets out a number of criteria.

Therefore, CEQ oversees the review of all such U.S. assessments. EIS' are also subject to judicial review for compliance with NEPA. Over time, an international culture of reviewing potential environmental impacts has developed, particularly in regard to major actions to be undertaken by international development banks or multinational corporations.

The EIA process requires the proponent to consider the most environmentally appropriate approach to achieving their intentions from the early planning stages. It also provides an opportunity for dialogue between the proponent and the assessing authority, with the aim of achieving a suitable outcome for the environment and for the proponent.
EIA Process for Heard Island and McDonald Islands
Prior to the commencement of any activity in the Territory of Heard Island and McDonald Islands (HIMI), the person or persons wishing to carry out the activity must prepare and submit an Environmental Impact Assessment (EIA), which is a report on the impact (if any) that the activity is likely to have on the HIMI environment. The EIA report must include alternatives to the proposal and details of mitigation measures that may be applied to reduce actual or potential environmental impacts. A Preliminary Assessment form must be completed and returned to the Environmental Policy and Protection Section of the Australian Government Antarctic Division, Channel Highway, Kingston, Tasmania 7050. Application forms should be submitted no less than six to eight weeks prior to departure of the ship to the subantarctic.

A key document in the development of the Viking Windfarm will be the Environmental Statement. The studies for the Environmental Statement are only just concluding so the information available at this stage (August 2006) is limited. When information for each chapter becomes available, it will be added to the website and registered visitors will be notified. The Environmental Statement is the presentation of the results of work undertaken to determine or assess the impact of the proposals on the existing local, national and global environment and then to consider measures to avoid, reduce or offset any adverse effects by mitigation. Consultation with stakeholders continues throughout every stage to ensure nothing is overlooked. The Environmental Statement is a considerable document and is broken down into chapters for ease of use. Each chapter covers a particular potential concern and considers the concern, the existing conditions, the potential impacts and potential mitigations.

Executive Summary
In connection with the worsening scarcity of fossil fuels and climate change the idea of using renewable energy is attracting interest both in the Swiss public eye and in industry. Fuels made from biomass - so-called biofuels - are currently the most important form of renewable energy in road transportation and could at least over the short to medium term take on a role in reducing greenhouse gases and our dependency on fossil fuels. In Switzerland therefore important political decisions have to be made against a background of giving a tax break for renewable fuels as opposed to diesel and petrol.
