The National Environmental Policy Act (NEPA) http://www.law.cornell.edu/uscode/html/uscode42/usc_sec_42_00004321000-notes.html was passed in 1970 along with the Environmental Quality Improvement Act http://www.law.cornell.edu/uscode/html/uscode42/usc_sec_42_00004371000-notes.html , the National Environmental Education Act http://www.law.cornell.edu/uscode/html/uscode20/usc_sec_20_00005501000-notes.html , and the Environmental Protection Agency (EPA) http://www.epa.gov/ . The main objective of these federal enactments was to assure that the environment be protected against both public and private actions that failed to take account of costs or harms inflicted on the eco-system. The EPA is supposed to monitor and analyze the environment, conduct research, and work closely with state and local governments to devise pollution control policies. NEPA (really enacted in 1969) has been described as one of Congress's most far reaching environmental legislation ever passed. The basic purpose of NEPA is to force governmental agencies to consider the effects of their decisions on the environment.

Although silica (silicon dioxide) exists abundantly in nature, it is normally found within sand and rock where it cannot be inhaled. Yet when used in construction materials, silica dust is a common byproduct of construction activity, and may be inhaled by workers. (Due to exposure risks from sandblasting activities, silicosis is sometimes also called "sandblasting disease".) Exposure to silica dust is now considered as hazardous to human health as exposure to asbestos
What Is Silica?
"Silica" is the common name for silicon dioxide, which is a compound formed from silicon and oxygen. Silica can exist in crystalline and noncrystalline forms. The most common natural form for silica is quartz, but it is also found in flint, agate, the sand found on beaches, and sandstone. Silica is also the main ingredient in glass.

Lichtenstein elissa@staff.abanet.org Description: In 1996 we published Directory of Pro Bono Legal Services Providers For Environmental Justice , a nationwide directory of legal service providers willing and able to take environmental justice cases. In addition, plans are in place to survey the providers about their case challenges and to update the directory, resources permitting. Volunteers and Cases: New phase of project to begin shortly. Expect 2-3 SCEL members and 1-2 staff to be involved. Awards ABA Award for Distinguished Achievement in Environmental Law and Policy, now in its 3rd year. (Note, in year 1 the institutional award went to Tulane Environmental Law Clinic for its environmental justice work; in year 2 the individual award went to Barry E.     Mediation of Mold Contamination Cases
    Ed McMahon, Erin Brokavich , the residents of Brier Creek Country Club in Raleigh, and the students at Topsail High School in Pender County, North Carolina all have one thing in common – they have encountered toxic mold from which litigation arose. Mold is an ancient problem that has as of late made its way into the courtroom with increasing frequency. It is estimated that about 10,000 mold-related lawsuits were filed nationwide in the last three years. This was likely fueled, at least in part, by reports of the huge jury verdicts in several high-profile mold cases. In June 2001, a Texas jury awarded homeowner Melinda Ballard over $32 million in damages (reduced to $4 million) against her insurer for mishandling mold related claims. In June 1996, a Florida jury awarded Martin County, Florida over $14 million against its construction manager and sureties for the defective construction of the county’s courthouse and office building that lead to mold contamination.

    Lead is a highly toxic substance that is found in the environment and can elicit serious health complications. Lead poisoning can occur when lead is ingested or inhaled, causing elevated levels of lead to enter the bloodstream. Once the lead enters the bloodstream, it can travel to tissues and major organs throughout the body causing serious damage. While adults and children can both experience the side effects of lead poisoning, severe cases are more common among children. Lead poisoning affects approximately 400,000 kids annually who have elevated blood levels due to lead exposure. There are a number of ways that a person can develop lead poisoning. Many of these risks are found in our everyday lives, inside and around our homes. Some common sources of lead and lead debris are household dust, drinking water, food, ceramics, hair dies, cosmetics and bare soil. The most common and harmful source of lead poisoning, however, is lead based paint. The US Department of Housing and Urban Development has determined that lead based paint is still present in at least 38 million homes nationwide. While the paint is not hazardous when it is in good condition, nearly 24 million of these homes exhibit significant hazards for lead poisoning. Lead paint in old homes becomes a risk when the paint begins to wear away causing microscopic lead debris to release into the air. Remodeling homes can also pose a significant threat to its inhabitants. Lead poisoning in children and adults can cause serious lasting health side affects. The side effects are particularly detrimental to children under six since their brains and central nervous systems are still developing. Children who are exposed to a low level of lead poisoning may experience reduced IQs, learning disabilities, stunted growth, attention deficit disorders, kidney damage or impaired hearing. Children exposed to higher levels of lead poisoning are at a great risk for metal retardation, coma and even death in some cases.

      The National Environmental Policy Act (NEPA) was passed in 1970 along with the Environmental Quality Improvement Act, the Environmental Education Act, and the Environmental Protection Agency (EPA). The main objective of these federal enactments was to assure that the environment be protected against both public and private actions that failed to take account of costs or harms inflicted on the eco-system. The EPA was supposed to monitor and analyze the environment, conduct research, and work closely with state and local governments to devise pollution control policies. NEPA (really enacted in 1969) has been described as one of Congress's most far reaching environmental legislation ever passed. The basic purpose of NEPA is to force governmental agencies to consider the effects on the environment of their decisions. State laws also reflect the same concerns and common law actions in nuisance allow adversely affected property owners to seek a judicial remedy for environtal harms harms.
