Institute of International Law (French Institut de Droit International ), nongovernmental society of international law specialists devoted to the development of international law , founded in 1873. The institute aims at clarifying general principles in international law and promoting codification of the law. Its membership is restricted to 132 specialists in the theory or practice of international law. Institute proceedings are conducted in French and English. The institute's work and proceedings are published in the Annuaire de l'Institut de droit international, the institute's yearbook. Headquarters, first in Ghent (Gent), Belgium, is now in Geneva. The institute was awarded the 1904 Nobel Peace Prize. Reviewed by: Institute of International Law Founders : Calvo, Carlos (1824-1906), Argentine diplomat, historian, and specialist in international law, born in Buenos Aires. As a diplomat Calvo represented at various times both Paraguay and Argentina as minister to Berlin, Belgium, Paris, London, Saint Petersburg, and Vienna. Today he is remembered for his writings on international law and as one of the founders of the Institute of International Law at Ghent (Gent), Belgium, in 1873. His principal work

Jump to: navigation search The Calvo Doctrine is a foreign policy doctrine which holds that jurisdiction in international investment disputes lies with the country in which the investment is located. The Calvo Doctrine thus proposed to prohibit diplomatic protection or (armed) intervention before local resources were exhausted. An investor, under this doctrine, has no recourse but to use the local courts , rather than those of their home country. The principle, named after Carlos Calvo , an Argentine jurist , has been applied throughout Latin America and other areas of the world. The doctrine arose from Calvos's ideas, expressed in his Derecho internacional te³rico y pr¡ctico de Europa y Am©rica Paris ; greatly expanded in subsequent editions, which were published in French ). Calvo justified his doctrine as necessary to prevent the abuse of the jurisdiction of weak nations by more powerful nations. It has since been incorporated as a part of several Latin American constitutions , as well as many other treaties statutes , and contracts . The doctrine is used chiefly in concession contracts , the clause attempting to give local courts final jurisdiction and to obviate any appeal to diplomatic intervention.

The members, invited by the organization, are persons who have demonstrated notable scholarly work in the area of international law, and is restricted to those who are considered relatively free of political pressure. The organisation attempts to have members broadly distributed around the world. The organisation holds biannual congresses for the study of international law as it currently exists, and passes resolutions proposing modifications to international law. It does not comment on specific disputes. Whilst its recommendations cover international law in its many forms, some of its resolutions particularly pertain to human rights law and peaceful dispute resolution. It is for this reason the organization received the Nobel Peace Prize in 1904.
