For purposes of this chapter - (a) The term ''commerce'' means commerce between any State, any territory, or the District of Columbia, and any place outside thereof; or within any territory not organized with a legislative body, or the District of Columbia.

On a world-wide basis, poultry play an important role in feeding people by providing a high-quality protein in the form of meat and eggs, scavenging unused feeds or by-products, and providing high-quality fertility to the soil by way of their manure. Poultry can convert feed more efficiently to meat and eggs than many other animals. Poultry, especially chicken meat, used to be considered a luxury item, but now is the least expensive meat available in the U.S. Poultry meat and eggs have a low retail cost at the grocery store because of a focus on production attributes: genetic selection, nutrition, management, and veterinary care and a trend to large-scale confinement production to increase production efficiency. Improving sustainability in poultry production means not only reducing costs and maximizing productivity but also a focus on bird health and welfare and other societal concerns. Large-scale production has led to geographical concentration of birds and their waste products, creating environmental concerns in some parts of the country in terms of water and air quality. Consumers have increasing concerns about food safety (food-born pathogens, pesticide residues, additives, antibiotic residues/resistance), nutritional (fat content, fatty acid profile, vitamins), value (appearance, flavor, traceability, regional production), and production process concerns (animal welfare, genetically modified organisms, environmental impact, worker safety, social justice), etc.

    Extractions: 888-SAFEFOOD At this time, the investigation indicates that approximately 30 broiler poultry farms and eight breeder poultry farms in Indiana received contaminated feed in early February and fed it to poultry within days of receiving it. All of the broilers believed to have been fed contaminated product have since been processed. The breeders that were fed the contaminated product are under voluntary hold by the flock owners. As with exposure from hogs fed contaminated pet food and for similar reasons related to the dilution of the contamination, FDA and USDA believe the likelihood of illness after eating chicken fed the contaminated product is very low. Because there is no evidence of harm to humans associated with consumption of chicken fed the contaminated product, no recall of poultry products processed from these animals is being issued. Testing and the joint investigation continue. If any evidence surfaces to indicate there is harm to humans, the appropriate action will be taken. Because the poultry being held have been fed adulterated products, USDA cannot knowingly approve products derived from these poultry for human consumption. USDA is offering to compensate producers who euthanize this poultry. USDA is also offering the expertise and assistance of Animal and Plant Health Inspection Service (APHIS) personnel in carrying out depopulation activities, to ensure adherence to Federal and State laws.

Avian influenza virus infection can occur in most, if not all, species of birds, both domestic and wild. Influenza viruses vary widely in their ability to cause disease (pathogenicity) and their ability to spread among birds. Wild species of birds usually do not develop clinical disease, but some influenza viruses cause severe illness or death in chickens, turkeys and guinea fowl. A highly pathogenic form of avian influenza was known as "fowl plague". It first appeared in Italy more than 100 years ago (around 1878). Pathogenic avian influenza was first recognized in the United States in 1924-25. It occurred again in 1929. It was eradicated both times. A major epidemic of highly pathogenic avian influenza occurred in the northeastern United States in 1983-84. It took more than 2 years to eradicate, at a cost of more than 70 million dollars. Approximately 17 million birds had to be destroyed during the eradication effort.
